Copyright Policy

1. Respect for Intellectual Property

Clipperia respects the intellectual property rights of others and expects its users to do the same. This Copyright Policy describes how we handle claims of copyright infringement and how you can notify us if you believe your copyrighted work has been infringed through our Service, in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

It is Clipperia's policy to respond to clear and complete notices of alleged copyright infringement and to terminate the accounts of repeat infringers in appropriate circumstances.

2. Designated Copyright Agent

Clipperia has designated an agent to receive notices of alleged copyright infringement. If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please send your notice to:

Please note that you may be liable for damages, including court costs and attorneys' fees, if you materially misrepresent that content is infringing. Before submitting a notice, you may wish to consult with legal counsel.

3. Filing a Copyright Complaint (DMCA Takedown Notice)

If you believe that content processed or stored through Clipperia infringes your copyright, you may submit a written takedown notice containing all of the following information:

1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
2. Identification of the infringing material that is claimed to be infringing or to be the subject of infringing activity, with sufficient detail for us to locate the material on the Service (e.g., a URL, username, or detailed description of the video);
3. Your contact information, including your full legal name, mailing address, telephone number, and email address;
4. A statement of good faith: "I have a good faith belief that use of the copyrighted material described in this notification is not authorized by the copyright owner, its agent, or the law";
5. A statement of accuracy, under penalty of perjury: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed";
6. Your physical or electronic signature (typing your full legal name at the end of the notice constitutes an electronic signature).

Important: A DMCA takedown notice that does not substantially comply with the requirements above may not be acted upon. We may request additional information to verify the claim before taking action.

4. Our Response to Valid Notices

Upon receipt of a valid DMCA takedown notice, Clipperia will take the following steps:

• Remove or disable access to the allegedly infringing material;
• Notify the affected user that the material has been removed or disabled, and provide them with a copy of the takedown notice (with the complainant's contact information redacted only where legally required);
• Inform the affected user of their right to submit a counter-notice as described in Section 5.

5. Counter-Notice Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a written counter-notice to our Designated Copyright Agent containing all of the following:

1. Your physical or electronic signature;
2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the competent courts of the City of Oaxaca de Juárez, State of Oaxaca, Mexico (the jurisdiction in which Clipperia is located), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.

6. Restoration of Removed Content

Upon receipt of a valid counter-notice, Clipperia will promptly provide the original complainant with a copy of the counter-notice and inform them that the removed material may be restored within ten (10) to fourteen (14) business days unless the complainant notifies us that they have filed a court action seeking a restraining order against the user to prevent further infringing activity.

If no such court action is filed within the ten-to-fourteen-day window, Clipperia may, at its discretion, restore the removed material and cease further action with respect to the specific notice.

7. Repeat Infringer Policy

Clipperia maintains and enforces a policy of terminating the accounts of users who are repeat infringers of copyrighted works in appropriate circumstances.

• A user may be considered a repeat infringer if Clipperia receives two or more valid DMCA takedown notices (or equivalent notices under applicable law) regarding that user's content within a twelve (12) month period;
• Repeat infringers may have their accounts suspended or permanently terminated at Clipperia's sole discretion;
• Terminated accounts are not eligible for refunds of any unused credits, remaining subscription time, or credit packs;
• Clipperia reserves the right to terminate an account after a single notice in cases of egregious or willful infringement.

Clipperia also reserves the right to deny access to the Service to any person who we reasonably believe to be a repeat infringer, including through the creation of new accounts.

8. False Claims & Misrepresentation

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Similarly, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification in a counter-notice may be subject to liability.
